The project promoter or, otherwise, the provisional administrator, must establish a sound administration, which may raise several questions. Registration and updating of syndicate information
Verification and collection of documents from the Register of Co-ownership
The Register of Co-ownership, as defined by the Act, must be prepared in such a way that it contains all the information necessary for the management and administration of the building. These documents must be deposited in the Register of Co-ownership for consultation by the co-owners.
Some examples: an authentic copy of the Declaration of Co-ownership, a copy of the cadastral plan and a copy of the certificate of location of all the private and common portions of the property, etc.
Creation of all required registers
The Register of Co-ownership contains, among other documents, a register of co-owners, a register of tenants, a register of restricted common areas and a register of mortgage holders.
Special meeting of co-owners for the election of the new board of directors, known as the "transition" board
This meeting is called within 90 days of the promoter losing a majority of the votes at the meeting of co-owners. Above all, it constitutes a loss of control by the promoter over the syndicate of co-ownership, which results in a “transfer of powers” between the provisional administration and the future administration of the co-ownership.
