Since October 15, 2020, it requires that all co-owners insure their liabilities towards third parties, which includes their own syndicates, other co-owners, tenants and other occupants. The implementing regulations specify a minimum amount of coverage. Most declarations of co-ownership already imposed such a requirement. Neither Article 1064.1 nor any other section of the Act imposes any other insurance coverage on the condo owner, including for improvements in their respective condo unit. by the declaration of co-ownership, in particular) obliged to ensure their improvements, the Law requires the Syndicate to make available (accessible upon request) to the co-owners a description of the private portions allowing them to identify the improvements. An improvement can be defined as a private element (private part excluding the common parts) added or modified with regard to the original state of the private part bringing an added value to it (the improvement corresponds to the added value).<\/span><\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-120bb4c elementor-widget elementor-widget-text-editor\" data-id=\"120bb4c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p><span class=\"ui-provider gr b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak\" dir=\"ltr\">The law does not specify any metrics to build this document other than to indicate that it is not necessary to have as many descriptions as there are units and that the same description can apply to several units. Certain documents may be useful in preparing a description, because they may contain clues as to the state of the building at a given time (the developer&#8217;s advertising documents when the project is marketed, the standard preliminary contract including the summary of the specifications, the information memorandum, addendums to the preliminary contracts, price lists, pre-purchase inspections or reception of private portions within the framework of warranty plans for new or optional residential buildings, evaluation reports for insurance purposes, photographs or videos, particularly with respect to a possible &#8220;model condo&#8221;).<\/span><\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-28cf18d elementor-widget elementor-widget-text-editor\" data-id=\"28cf18d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p><span class=\"ui-provider gr b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak\" dir=\"ltr\">Also, PL 41 (art. 200) specifies that the description must obtain the approval of the co-owners at a meeting, representing more than half of the votes of the co-owners, present or represented. Since April 15, 2022, it requires all Syndicates to establish a self-insurance fund. As of April 15, 2022, they must establish a second self-insurance fund (see&nbsp;1071.1).<\/p>\n<p>The implementing regulation specifies that a maximum of 2 years is given to constitute or reconstitute this fund so that it reaches the highest deductible on the syndicate&#8217;s insurance policy, excluding, if applicable, the deductibles applicable in case of damage caused by an earthquake or flood.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3f22af elementor-widget elementor-widget-spacer\" data-id=\"d3f22af\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-50f6bc2 elementor-widget elementor-widget-text-editor\" data-id=\"50f6bc2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/en\/document\/cr\/CCQ,%20r.%204.1\" target=\"_blank\" rel=\"noopener\"><strong>R\u00e8glement 442-2020<\/strong><\/a>\u00a0&#8211;<strong>\u00a0article 2<\/strong>\u00a0: \u00ab<em>\u00a0<span class=\"Subsection\">The minimum contribution of the co-owners of an immovable held in divided co-ownership to the self-insurance fund established under article 1071.1 of the Civil Code is determined on a yearly basis when the sums to be paid into the contingency fund are determined, in the following manner:<\/span><\/em><\/p><div id=\"se:2-ss:1\" class=\"Subsection SubsectionFirst\"><div id=\"se:2-ss:1-p1:1\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>1<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">where the capitalization of the self-insurance fund is less than or equal to half of the highest deductible amount of the insurance taken out by the syndicate of co-owners, the contribution is equal to half of that deductible;<\/span><\/em><\/div><div id=\"se:2-ss:1-p1:2\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>2<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">where the capitalization of the fund is greater than half of the highest deductible amount of the insurance taken out by the syndicate, the contribution is equal to the amount resulting from the difference between that deductible and the capitalization of the fund; and<\/span><\/em><\/div><div id=\"se:2-ss:1-p1:3\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>3<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">where the capitalization of the fund is greater than or equal to the highest deductible amount of the insurance taken out by the syndicate, no contribution is required.<\/span><\/em><\/div><div>\u00a0<\/div><\/div><div id=\"se:2-ss:2\" class=\"Subsection\"><em><span class=\"Subsection\">For the purposes of the first paragraph, the deductible applicable to damage caused by an earthquake or by flooding, if that protection is provided for on the insurance contract, is not taken into account.<\/span><\/em><\/div><div>\u00a0<\/div><div id=\"se:2-ss:3\" class=\"Subsection\"><span class=\"Subsection\"><em>Despite the foregoing, where the minimum contribution of co-owners to the self-insurance fund determined pursuant to subparagraphs 1 and 2 of the first paragraph increases the capitalization of the fund to over $100,000, that contribution may be lowered in order that the capitalization of that fund is at least\u202f$100,000<\/em>\u00a0<\/span>\u00bb.<\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4194b9 elementor-widget elementor-widget-spacer\" data-id=\"c4194b9\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-39f093a elementor-widget elementor-widget-heading\" data-id=\"39f093a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1073 | Insurable interest | Liability insurance | Regulations    <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3827448 elementor-widget elementor-widget-text-editor\" data-id=\"3827448\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">Since January 1, 1994, all Syndicates have been obliged to take out property and liability insurance. With PL 141, the contours of this mandatory insurance have been modified. The Declaration of Co-ownership may also provide for additional insurance obligations.\u00a0<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9c875d0 elementor-widget elementor-widget-text-editor\" data-id=\"9c875d0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Property insurance<\/u><\/strong><\/p><p style=\"font-weight: 400;\">Property insurance must include a reasonable deductible. The Bill provides that the government may, by regulation, determine the cases in which a deductible is considered unreasonable. To date, there are no such regulations.<\/p><p style=\"font-weight: 400;\">The reasonableness of a deductible depends on the particular situation. A deductible could be reasonable for a building with a history of claims or risks, and unreasonable for another building.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3453382 elementor-widget elementor-widget-text-editor\" data-id=\"3453382\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">The law provides that property insurance excludes improvements made by a co-owner to his part when they can be identified in relation to the description of that part. It is possible to conclude from this that if the syndicate fails to make such description(s) available, it is obliged to insure the entire immovable.\u00a0<\/p><p style=\"font-weight: 400;\">The insurable value of the building, which must be included in the property insurance, must provide for the reconstruction of the building in accordance with the standards, practices, and rules of the trade applicable at the time.\u00a0<span style=\"caret-color: #000000; color: #000000; text-align: start;\"><span class=\"ui-provider gs b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak\" dir=\"ltr\">We thus move from new replacement cost insurance to new replacement cost insurance for reconstruction.<\/span><\/span>\u00a0This value must be appraised by a certified appraiser (according to the implementing regulations) at least every 5 years.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-31ab984 elementor-widget elementor-widget-text-editor\" data-id=\"31ab984\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">Property insurance must cover the usual risks. These risks are defined by government regulation. They are covered by law.\u00a0 The law enshrines a form of all-risk insurance (everything is covered, except what is expressly excluded) against limited-risk insurance (only what is specified is covered).\u00a0 This coverage can be reduced, provided that the risks covered by law are expressly excluded in the insurance policy or in an endorsement, and in clear (typographical) print.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11d50d8 elementor-widget elementor-widget-spacer\" data-id=\"11d50d8\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e984602 elementor-widget elementor-widget-text-editor\" data-id=\"e984602\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Liability insurance<\/u><\/strong><\/p><p style=\"font-weight: 400;\">The Syndicate must not only insure its own liability (since January 1, 1994), but also that of the individuals who operate the Syndicate on a day-to-day basis.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1c21c3b elementor-widget elementor-widget-text-editor\" data-id=\"1c21c3b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div><span lang=\"EN-CA\">Most Declarations of Co-ownership already required directors to be insured. The Bill goes one step further, imposing insurance not only for directors, but also for officers of the meeting (president and secretary) and for the manager. The term &#8220;third party&#8221; should not be misunderstood here. This includes not only outsiders to the co-ownership and people who live or work in the building but are not owners, but also the co-owners themselves and their successors in title. <\/span><\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-944ab2c elementor-widget elementor-widget-text-editor\" data-id=\"944ab2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">The syndicate can be held liable on a number of occasions. In particular, the syndicate is: &#8221; [&#8230;] <em>liable for damage caused to the co-owners or third persons by faulty design, construction defects or lack of maintenance of the common portions, without prejudice to any recursory action<\/em>&#8221; (art. 1077 C.C.Q.).<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e2ef51 elementor-widget elementor-widget-spacer\" data-id=\"9e2ef51\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-317bcfd elementor-widget elementor-widget-text-editor\" data-id=\"317bcfd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Special rules<\/u><\/strong><\/p><p style=\"font-weight: 400;\">It is possible to provide, by bylaw, for rules governing the syndicate&#8217;s insurance coverage that vary according to the different categories of buildings, notably in terms of size, value and geographic location. For the moment, the implementing regulations do not contain any special rules for small condominiums, for example. All condominiums are subject to the same obligations.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-314ae04 elementor-widget elementor-widget-spacer\" data-id=\"314ae04\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6857fc9 elementor-widget elementor-widget-heading\" data-id=\"6857fc9\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1074.1 | Loss | Immunity    <\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b01cd41 elementor-widget elementor-widget-text-editor\" data-id=\"b01cd41\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">This article is new. It provides that the Syndicate (i.e. the Board of Directors) may decide not to make a claim against its insurer, even in the event of a loss likely to trigger the cover provided under the policy. There is a distinction to be made here between declaring a claim and claiming the application of the cover that may result from it.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e9c296 elementor-widget elementor-widget-text-editor\" data-id=\"4e9c296\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">Furthermore, while the Syndicate has a choice here, as provided for in paragraph 1, the consequences are set out in paragraph 2. The Syndicate must see to any post-loss work that would normally have been covered by the insurer. Furthermore, the Syndicate cannot impose the consequences of its choice on the co-owners or any other persons in its home (young children, for example). It has no recourse, even in the event of fault on their part, for amounts that would normally have been covered by the Syndicate\u2019s insurer.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e16c268 elementor-widget elementor-widget-spacer\" data-id=\"e16c268\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2335ad2 elementor-widget elementor-widget-text-editor\" data-id=\"2335ad2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div id=\"se:1074_1-ss:1\" class=\"Subsection SubsectionFirst\"><span class=\"Subsection\"><strong>1074.1<\/strong> \u00ab <em>When a loss occurs which falls under the coverage provided for by a property insurance contract entered into by the syndicate and the syndicate decides not to avail itself of the insurance, it shall with dispatch see that the damage caused to the insured property is repaired.<\/em><\/span><\/div><div>\u00a0<\/div><div id=\"se:1074_1-ss:2\" class=\"Subsection\"><em><span class=\"Subsection\">A syndicate that does not avail itself of insurance may not sue the following persons for the damages for which it would otherwise have been indemnified by the insurance:<\/span><\/em><div>\u00a0<\/div><div id=\"se:1074_1-ss:2-p1:1\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>1<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">a co-owner;<\/span><\/em><\/div><div id=\"se:1074_1-ss:2-p1:2\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>2<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">a person who is a member of a co-owner\u2019s household; or<\/span><\/em><\/div><div id=\"se:1074_1-ss:2-p1:3\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>3<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><\/em><span class=\"Paragraph\"><em>a person in respect of whom the syndicate is required to enter into an insurance contract to cover the person\u2019s liability<\/em> \u00bb.<\/span><\/div><\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aed1ad8 elementor-widget elementor-widget-spacer\" data-id=\"aed1ad8\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ddbda3 elementor-widget elementor-widget-heading\" data-id=\"1ddbda3\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1074.2 | Recovery | Nullity<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-13582de elementor-widget elementor-widget-text-editor\" data-id=\"13582de\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">This article is new. Where they relate to restricted-use common portions of the immovable, such as work on them, the possibly different apportionment provided for in the Declaration of Co-ownership must be applied (ref. art. 1064, para. 2 C.C.Q.).<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a5e0548 elementor-widget elementor-widget-text-editor\" data-id=\"a5e0548\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Damages <\/u><\/strong><\/p><p style=\"font-weight: 400;\">As an exception, the Bill provides for the Syndicate&#8217;s right of recourse in the event of :<\/p><ul><li style=\"font-weight: 400;\">fault of the co-owner;<\/li><li style=\"font-weight: 400;\">the act of a person for whom he is responsible (added March 17, 2020);<\/li><li style=\"font-weight: 400;\">an act involving property in the co-owner&#8217;s custody (added March 17, 2020).<\/li><\/ul>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-83b5b0b elementor-widget elementor-widget-text-editor\" data-id=\"83b5b0b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">Any stipulation to the contrary is deemed unwritten. However, it must be contrary. There is no legal requirement to be an insurance trustee. Most declarations of co-ownership require that the trustee be a member of a professional order that ensures the protection of sums held in trust by its members. This is the case for members of the Quebec Bar or the <em>Chambre des notaires du Qu\u00e9bec<\/em>. It is also advisable to do business with a professional with expertise in the field, particularly in co-ownership law. \u00a0<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4613a2a elementor-widget elementor-widget-text-editor\" data-id=\"4613a2a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">The law also stipulates that a government regulation may specify the criteria for qualifying a loss as significant.\u00a0 For the time being, the implementing regulations are silent in this regard.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5071571 elementor-widget elementor-widget-text-editor\" data-id=\"5071571\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div id=\"se:1074_2-ss:1\" class=\"Subsection SubsectionFirst\"><span class=\"Subsection\"><span class=\"Subsection\"><strong>1075.<\/strong> \u00ab\u00a0<\/span><\/span><em><span style=\"font-size: 1rem;\">The indemnity owing to the syndicate following a substantial loss is, notwithstanding article 2494, paid to the trustee appointed in the act constituting the co-ownership or, where none has been appointed, to a trustee who must be designated without delay by the syndicate.<\/span><\/em><\/div><div class=\"Subsection SubsectionFirst\"><div>\u00a0<\/div><div id=\"se:1075-ss:2\" class=\"Subsection\"><em><span class=\"Subsection\">The indemnity shall be used to repair or rebuild the immovable, unless the syndicate decides to terminate the co-ownership, in which case the trustee, after determining each co-owner\u2019s share of the indemnity according to the relative value of his fraction, pays the prior and hypothecary creditors out of that share according to the rules in article 2497. <\/span><\/em><em><span class=\"Subsection\">For each of the co-owners, he remits the balance of the indemnity to the liquidator of the syndicate with his report.<\/span><\/em><\/div><div>\u00a0<\/div><div id=\"se:1075-ss:3\" class=\"Subsection\"><span class=\"Subsection\"><em>A government regulation may determine the criteria for characterizing a loss as substantial\u00a0<\/em><\/span><em style=\"font-size: 1rem;\"><span class=\"Subsection\">\u00bb<\/span><\/em><\/div><\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4772f5 elementor-widget elementor-widget-spacer\" data-id=\"d4772f5\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e493c9a elementor-widget elementor-widget-heading\" data-id=\"e493c9a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1075.1 | Subrogation | Exception<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bfad48b elementor-widget elementor-widget-text-editor\" data-id=\"bfad48b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">This article is new. It deals with the subrogatory recourse of an insurer in co-ownership.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-176aa40 elementor-widget elementor-widget-text-editor\" data-id=\"176aa40\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Prohibition of recourse<\/u><\/strong><\/p><p style=\"font-weight: 400;\">It prohibits subrogated recourse by an insurer who has paid compensation. The insurers concerned are those of the persons listed, and the recourse in question is against those same persons. For example, the insurer of a syndicate wishing to take recourse against a contractor totally unrelated to the co-ownership would not be restricted by this article. On the other hand, it would be against a co-owner at fault.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f642645 elementor-widget elementor-widget-text-editor\" data-id=\"f642645\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\"><strong><u>Exception<\/u><\/strong><\/p><p style=\"font-weight: 400;\">The principle of non-subrogation does not apply in cases of bodily or moral injury. This is an important exception. It would not be possible to have it seized for the purpose of enforcing a judgment unrelated to a sum to which this fund is assigned.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0d3dc93 elementor-widget elementor-widget-text-editor\" data-id=\"0d3dc93\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">On the other hand, a co-owner who has been unjustly charged with the payment of an expense that should normally have been paid from this fund could probably, and by virtue of a judgment to that effect, proceed to have it seized in order to be reimbursed in the event that the Syndicate does not voluntarily comply with the said judgment.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8fd08b3 elementor-widget elementor-widget-text-editor\" data-id=\"8fd08b3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div id=\"se:1074_2-ss:1\" class=\"Subsection SubsectionFirst\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><strong>1078.<\/strong> \u00ab\u00a0<\/span><\/span><\/span><\/span><em><span style=\"font-size: 1rem;\">A judgment condemning the syndicate to pay a sum of money is executory against the syndicate and against each of the persons who were co-owners at the time the cause of action arose, proportionately to the relative value of his fraction.<\/span><\/em><\/div><div>\u00a0<\/div><div class=\"Subsection SubsectionFirst\"><em style=\"font-size: 1rem;\">The judgment may not be executed against the contingency fund, except for a debt arising from the repair of the immovable or the replacement of common portions, or against the self-insurance fund, unless the judgment is in respect of the recovery of an amount for the payment of which the fund is to be used<\/em><span style=\"font-size: 1rem;\"> \u00bb.\u00a0<\/span><\/div><div class=\"Subsection SubsectionFirst\">\u00a0<\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c5ea2a elementor-widget elementor-widget-spacer\" data-id=\"2c5ea2a\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-27f6e54 elementor-widget elementor-widget-heading\" data-id=\"27f6e54\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1097 | Double majority<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53f3bb8 elementor-widget elementor-widget-text-editor\" data-id=\"53f3bb8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">Article 1097 deals with decisions taken by the general meeting of co-owners by a more demanding majority than those provided for in article 1096 C.c.Q. Since March 17, 2020, modifications to the description(s) of private portions must not only be approved by the meeting, but also by the majority provided for in article 1097.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f74568c elementor-widget elementor-widget-text-editor\" data-id=\"f74568c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div id=\"se:1074_2-ss:1\" class=\"Subsection SubsectionFirst\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><strong>1097.<\/strong> \u00ab <em>Decisions concerning the following matters are made by co-owners representing three-quarters of the votes of the co-owners present or represented:<\/em><\/span><\/span><\/span><\/span><\/span><\/div><div class=\"Subsection SubsectionFirst\"><div>\u00a0<\/div><div id=\"se:1097-ss:1-p1:1\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>1<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">acts of acquisition or alienation of immovables by the syndicate;<\/span><\/em><\/div><div id=\"se:1097-ss:1-p1:2\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>2<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">work for the alteration, enlargement or improvement of the common portions, the apportionment of the cost of the work and the granting of a movable hypothec to finance it;<\/span><\/em><\/div><div id=\"se:1097-ss:1-p1:3\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>3<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">the construction of buildings to create new fractions;<\/span><\/em><\/div><div id=\"se:1097-ss:1-p1:4\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>4<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">the amendment of the act constituting the co-ownership or of the description of the fractions;<\/span><\/em><\/div><div id=\"se:1097-ss:1-p1:5\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>5<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><\/em><span class=\"Paragraph\"><em>the amendment of the description of the private portions referred to in section\u00a01070<\/em>\u00a0<\/span><span style=\"font-size: 1rem;\">\u00bb.\u00a0<\/span><\/div><\/div><div class=\"Subsection SubsectionFirst\">\u00a0<\/div>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ac4612f elementor-widget elementor-widget-spacer\" data-id=\"ac4612f\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f85f87 elementor-widget elementor-widget-heading\" data-id=\"8f85f87\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Art. 1106.1 | Duty and liability of the developer<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4197eb8 elementor-widget elementor-widget-text-editor\" data-id=\"4197eb8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">This article is new. It sets out the documents that must be submitted by the developer within 30 days of the transition meeting provided for in article 1104. These documents include a description of the private portions.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d5dc056 elementor-widget elementor-widget-text-editor\" data-id=\"d5dc056\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">In the event of failure to do so, the developer may be required to compensate the syndicate for any loss suffered. The consequence provided for in article 1073 (see our comments) also applies in this situation.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef94332 elementor-widget elementor-widget-text-editor\" data-id=\"ef94332\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<p style=\"font-weight: 400;\">The Syndicat must insure the entire building as if there were no improvement, until such time as this description is made available to the co-owners. Any resulting prejudice to the Syndicat would also be compensable by the developer, who therefore has every interest in providing this documentation as soon as possible, and even well before the transitional meeting.<\/p>\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1fdf130 elementor-widget elementor-widget-text-editor\" data-id=\"1fdf130\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\">\n\t\t\t\t<div id=\"se:1074_2-ss:1\" class=\"Subsection SubsectionFirst\"><p><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><span class=\"Subsection\"><strong>1106.1.<\/strong> \u00ab\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><em><span style=\"font-size: 1rem;\">Within 30 days of the special meeting, the developer shall provide the following to the syndicate:<\/span><\/em><\/p><div id=\"se:1106_1-ss:1\" class=\"Subsection SubsectionFirst\"><div id=\"se:1106_1-ss:1-p1:1\" class=\"Paragraph InForce\"><div class=\"Global inforcedMessage\"><em><span style=\"background-color: #d3d3d3;\"><i>Not in force<\/i><\/span><\/em><\/div><p><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\"><span style=\"background-color: #d3d3d3;\"><i>(<i><\/i>1<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/i><\/span><span class=\"Paragraph\"><span style=\"background-color: #d3d3d3;\"><i>the maintenance log kept for the immovable and the contingency fund study;<\/i><\/span><\/span><\/span><\/span><\/em><\/p><\/div><div id=\"se:1106_1-ss:1-p1:2\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>2<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">where the immovable is new or has been renovated by the developer, the plans and specifications showing any substantial changes made to it during construction or renovation in comparison with the original plans and specifications;<\/span><\/em><\/div><div id=\"se:1106_1-ss:1-p1:3\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>3<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">the other plans and specifications relating to the immovable that are available;<\/span><\/em><\/div><div id=\"se:1106_1-ss:1-p1:4\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>4<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">the location certificates relating to the immovable that are available;<\/span><\/em><\/div><div id=\"se:1106_1-ss:1-p1:5\" class=\"Paragraph\"><em><span class=\"Label-Z LabelBase\"><span class=\"normal LabelBase\">(<\/span>5<span class=\"normal LabelBase\">) <\/span><span class=\"WidthFixForLabel\">\u00a0<\/span><\/span><span class=\"Paragraph\">the description of the private portions provided for in article 1070;
